Trena Berum: The law is a bit vague, but I believe that a proper interpretation would be that it is unlawful only to use a device to communicate with another person. (Veh C 23123, and see 23123.5.) However, since the law is unclear, I would suggest avoiding a problem by not trying to manage your music while driving. Even if not illegal, it is, as you note, still dangerous.

Chris Wilczewski: In New York it is still illegal. It falls under! a title code of "Operating a handheld electronic while driving". The law code lists a handheld electronic as a GPS a phone an MP3 player or any other portable electronic. New York and California have very similar laws So I would assume that it would apply there as well.
